To respect and protect the intellectual property rights of electronic resources, safeguard the reputation of ECNU, and ensure the legitimate rights of authorized users in the proper use of ECNU’s electronic resources (hereinafter referred to as “electronic resources”), these regulations are hereby established.

I. Definition of Electronic Resources

“Electronic resources” refer to officially published digital materials released by domestic or international publishers for which ECNU has purchased campus-wide or departmental access rights, as well as digital resources developed by ECNU. These include databases, electronic journals, e-books, and multimedia resources.

II. Definition of Authorized Users

“Authorized users” include ECNU faculty and staff, enrolled students, international students, visiting scholars, and training teachers who are officially registered with the relevant ECNU departments.

III. Fair Use

“Fair use” refers to legitimate users’ retrieval, browsing, downloading, or printing of electronic resources at a normal speed for the purposes of learning, teaching, or scientific research, in accordance with relevant laws and regulations.

IV. Account Security

To prevent unauthorized use of ECNU’s electronic resource accounts (i.e., ECNU authentication credentials), users must properly protect their account credentials and set complex passwords. According to the ECNU Regulations on the Use and Management of Campus Cards, any operation conducted under a user’s password is regarded as performed or approved by the account holder.

V. Prohibited Actions

Authorized users who engage in any of the following behaviors will be subject to penalties specified in Article VI:

1.Setting up proxy servers to provide off-campus access to ECNU’s licensed electronic resources for non-authorized users.

2.Using software tools to perform bulk downloading (including the automatic batch download function in EndNote or similar reference management software), or continuously and intensively downloading at abnormal speeds, or downloading entire issues of electronic journals.

3.Lending or renting personal accounts to non-authorized users, or providing downloaded materials in bulk to others; or failing to safeguard account information, resulting in misuse by others.

4.Using downloaded materials for commercial purposes.

5.Committing any other act that violates relevant laws, regulations, or university policies.

VI. Penalties for Violations

1.The violator must submit a written explanation and self-inspection report to the library or relevant university departments.

2.Under the supervision of the library or the responsible person of relevant ECNU unit, all illegally downloaded files and data must be deleted.

3.The violation and violator will be publicly reported within the university.

4.Depending on the severity of the violation, the violator’s borrowing privileges may be suspended for 2 to 6 months, and electronic resource access rights may be suspended for 1 to 3 months; serious cases will be submitted to the ECNU Management for disciplinary action.

5.The violator shall bear all intellectual property disputes and legal liabilities arising from the violation.

VII. Interpretation

East China Normal University Library is responsible for the interpretation of these regulations.

VIII. Implementation

These regulations take effect upon publication. Previous versions shall be repealed accordingly.
